And you need to check the procedural rules of whatever court you’re in, because standing orders on AI are popping up all over the place. There’s at least one court in the Northern District of California that requires a signed certi { cation that the lead trial lawyer has personally validated anything submitted to that court. But the real problem that trial lawyers need to start thinking about now is, what am I going to do if I either need to get this evidence admitted, or if I need to prevent this evidence from being admitted? Be very thoughtful about those issues early on because I think they’re going to be much more challenging than they’ve been up to this point.
